Terms of service
Last updated:
These terms govern the use of Lekalao, the e-mail platform reached at panel.lekalao.com and through its API (the “service”). The service is provided by Lekalao, Douala, Cameroon (“Lekalao”, “we”).
They bind the organisation that opens an account (“you”) as soon as the account is opened. If you open it for an organisation, you confirm that you may commit it. The data processing agreement forms part of these terms.
1. What the service is
Lekalao lets a team keep its lists of contacts, write and send campaigns, run automations and send the e-mails its applications produce, and measure what happens to them.
Lekalao does not deliver e-mail itself and does not resell sending. Every e-mail leaves through a sending provider that you choose, contract with and pay (section 5).
2. Accounts and teams
- An account belongs to one person and requires a verified e-mail address. Nothing in the service is reachable before the address is verified.
- A team groups the people who work together. You decide who is a member and with which role (Owner, Editor, Writer, Viewer), and you are responsible for what members do in your team.
- Keep your password and your API tokens to yourselves. Two-factor authentication and passkeys are available, and a team can require them of every member.
- Tell us without delay if you believe an account or a token has been used by someone else.
3. Plans, the free plan and trials
A plan is two limits: a number of subscribers and a number of e-mails a month. Every feature is in every plan. The plans and their limits are those shown on the plans page when you choose one.
- Free has no time limit and asks for no payment method, within its limits of 1,000 subscribers and 10,000 e-mails a month.
- Starter, Growth and Pro can be tried for 14 days without a payment method.
- On day 15, if you have not paid, your team goes back to Free. Nothing is deleted; Free’s limits apply from then on.
- Scale has limits agreed with you in writing.
A subscriber is one active address on one list; someone who unsubscribed does not count. Past the subscriber limit, new addresses are refused and those you have keep working. Past the e-mails of the month, a campaign that would exceed them waits instead of leaving half-sent.
4. Prices and payment
- Prices are those on the plans page at the time of payment, in the currency you choose among those offered. Each price is set in its own currency.
- Payment goes through our payment gateway, Wajub, by the means it offers (Mobile Money, card or transfer). Your payment details are entered with Wajub; we never see them.
- One payment covers the period you chose: one, three, six or twelve months. Nothing renews by itself.
- We remind the team’s billing address and its owners seven days before a paid period ends, the day before, and the morning it ends.
- When a period ends unpaid, you have seven days to pay. Sending then pauses until you pay. Nothing is deleted.
- A change of price applies from your next period, never to a period already paid, and is announced at least 30 days ahead.
- A period paid is not refunded, except where the law requires it or where we end the service without fault on your part, in which case we refund the part not used.
- Taxes, where they apply, are shown at the time of payment. If you need an invoice for a payment, write to us.
5. Your sending provider
You choose the provider through which your e-mails leave (Amazon SES, Postmark, Mailgun, SendGrid, Brevo, Resend or an SMTP server), contract with it, follow its terms and pay its charges directly.
Lekalao keeps the credentials you give it encrypted, and uses them only to send what you ask, to test the connection and to read what the provider reports about delivery.
Delivery to the inbox depends on your provider, your domain and your list. Lekalao helps you protect it; it cannot promise it.
6. Acceptable use
You may send only to people who asked for it, or whom the law that applies to you allows you to write to. In particular, you agree not to:
- send to lists bought, rented, borrowed or collected without the people’s knowledge;
- send a marketing e-mail without a working unsubscribe link and your postal address (the service refuses it);
- write in the name of a domain or an organisation you do not control;
- send phishing, malware, deceptive or illegal content, or content that incites hatred or violence;
- try to reach another team’s data, to get round the limits of your plan, to test the service’s defences without our agreement, or to overload it.
A campaign whose complaints or bounces pass the thresholds pauses by itself. We may pause a sending, or suspend a team, that puts recipients, providers or other customers at risk; we tell you why, and lift it once the cause is settled. A serious or repeated breach allows us to end the service under section 11.
7. Your data
What you put into the service — contacts, content, settings, statistics — is yours. You grant us only the rights needed to host it and process it in order to provide the service.
For the personal data of your contacts, you are the controller and we are your processor, under the data processing agreement. The privacy policy says how we handle the data of the people who use the service and of the visitors of this site. The subprocessors we rely on are listed.
You can export your contacts and your blocklist at any time, and give any person the file of what you hold about them. We do not sell your data, and we do not use your contacts for anything but the service you ask of us.
8. Security
We protect the service and your data with the measures described on the security page, which we keep up to date. If a breach affects personal data you entrusted to us, we tell you as the data processing agreement provides.
9. Availability and changes to the service
We work to keep the service available and to fix what breaks, but we do not promise that it will be uninterrupted or free of errors, and we offer no level of availability. Maintenance that may interrupt it is announced in advance when it can be.
The service changes as it improves. If we remove something you rely on, we tell you ahead of time.
10. What belongs to whom
The service, its software, its documentation and the Lekalao name and logo belong to us; these terms give you the right to use the service, nothing more. Ideas you send us may be used freely, without obligation.
11. Ending the service
- You may stop at any time: stop paying, and your team goes back to Free at the end of the period paid; delete your own account from your settings; or ask us in writing to delete your team.
- We may end the service for a serious breach of these terms, after telling you and, when the breach can be remedied, giving you time to remedy it; or immediately when needed to protect recipients, providers, other customers or the service.
- If we stop offering the service altogether, we tell you at least 90 days ahead.
- When a team is closed, its data remains available for export for 30 days, then is deleted within the following 30 days, except what the law obliges us to keep. Copies in backups disappear as those backups are replaced.
12. Liability
The service is provided with care, as it is. To the extent the law allows, we are not liable for the acts or failures of your sending provider, for what happens to an e-mail once your provider has accepted it, for content you send, or for indirect losses such as lost revenue or lost data you could have exported.
Our total liability for any claim arising from the service is limited to the amounts you paid us in the twelve months before the event that caused it. Nothing in these terms limits a liability that the law does not allow to be limited.
13. Changes to these terms
We may change these terms. We announce a change by e-mail to the owners of each team and on this page at least 30 days before it applies, unless the law requires it sooner. If you do not accept it, you may end the service before it applies; using the service afterwards means you accept it.
14. Applicable law and disputes
These terms are governed by the law of Cameroon. In case of a dispute, we will first look for an amicable settlement; failing that within 30 days, the competent courts of Douala have jurisdiction, unless a mandatory rule of law gives jurisdiction elsewhere.
